UPDATED - Jolt Fitness gyms to stay open pending appeal

8 March 2013 - Following the issuing of an interim injunction requiring that the three former Club Physical gyms now branded as Jolt Fitness should immediately stop trading, Jolt Fitness has advised that the gyms will remain open pending appeal

Stewart Germann, lawyer for franchisee Stuart Holder and his Colven companies, has advised:

'An appeal against the Judgment of Winkelmann J will be filed today with the Court of Appeal and an urgent Application for a Stay in the Order of the High Court will be filed today at the Auckland High Court as Counsel believes there are strong grounds for the appeal and the stay. Meanwhile the gyms will remain open for business.'

Justice Helen Winkelmann yesterday ruled in favour of the injunction request by Club Physical for Jolt Fitness to cease operations. 

Commenting on the ruling, Stuart Holder, Director of Jolt Fitness, said yesterday. 'We are incredibly surprised and disappointed by Justice Winkelmann’s ruling.  We are waiting on our lawyers to advise on whether an urgent appeal should be filed. We expect to have this advice by tomorrow morning. If an appeal is filed, we will be seeking to continue to operate our clubs until that appeal is heard. Our first priority remains our staff, and to continuing to provide a first-class fitness facility to our members.'
